Terms of Service

Last updated: September 25, 2026

These terms are an agreement between you and Orbita Markets, LLC, a Delaware limited liability company ("Órbita", "we"). They govern orbita.markets, app.orbita.markets and the MCP server at https://mcp.orbita.markets (together, the "Service"). By creating an account, subscribing or connecting an agent, you accept them.

1. What Órbita is

Órbita publishes market research on US-listed companies: company theses, upcoming catalysts and general trading plans (Órbita Pulso, short term, and, in the 6-month and annual plans, Órbita Horizonte, long term), updated during US market hours. The research and the plans are produced by AI agents operated by Órbita, within fixed rules that Órbita sets and publishes. The Service delivers that research to AI assistants ("agents") through an API that follows the Model Context Protocol.

The Service also includes a research base: the desk's curated notes and references to primary sources such as SEC filings, federal contract records and company press releases, with links to the originals. Third-party content is provided as-is, may contain errors and remains the property of its authors; Órbita does not endorse it.

The same research and the same plan are published to every subscriber. When your agent sends account figures (cash, positions, open orders), the Service applies fixed, published rules to those figures to express the general plan in share quantities and prices. That calculation is mechanical: it does not take into account your objectives, financial situation, risk tolerance or any other personal circumstance.

The companies covered (the "universe") are chosen by Órbita and may change over time: names can be added or removed without notice. The current list is always available on the website and through the Service.

2. Not investment advice

Órbita is a publisher of general, impersonal information. It is not a broker-dealer, investment adviser, portfolio manager or financial planner, and nothing in the Service is a personalized recommendation, an offer or a solicitation to buy or sell any security.

We never hold your money, never access or operate your brokerage account and never receive your brokerage credentials. You, or an agent you control, decide whether to act on any information and place any orders on your own account, at your own risk. We do not have a fiduciary or advisory relationship with you.

If you need advice suited to your situation, consult a licensed professional.

Conflicts of interest: Órbita, its owners and accounts they control may hold or trade the securities covered by the Service, including by executing the published plan. They never trade on a plan before it is published to subscribers, and Órbita receives no compensation from the companies it covers.

3. Risk

Trading securities involves substantial risk, including the loss of all the money you invest. Short-term trading is especially risky. Past or simulated results do not guarantee future results, and Órbita does not promise any return.

Órbita Horizonte, the long-term portfolio of the 6-month and annual plans, is concentrated in five sectors, holds positions over weekends and holidays, and uses wider exits (stop at −10% and take profit at +20% from cost), so a single position can lose more than under Órbita Pulso before it is sold. It uses half of your account; the other half follows Órbita Pulso.

Market data may be delayed, incomplete or wrong, plans may expire without being replaced, and agents, brokers and networks can fail. You are responsible for supervising your agent and for every order placed on your account.

Hypothetical performance: any simulated or backtested results shown on the Service come from a model account with a simulated broker and stated assumptions (slippage, no commissions, dividends or taxes). They are not the results of any real account, may use rules that differ from the desk's plans, benefit from hindsight in their design, and do not reflect the effect of real execution. They do not guarantee future results.

4. Your account

You must be at least 18 years old and able to enter into a binding contract. You are responsible for your account, for the agents you authorize and for keeping your email and devices secure. You can revoke an agent's access at any time from your account.

Never send brokerage credentials, passwords or API keys to Órbita. The Service does not ask for them and does not need them.

5. Subscription, renewal and cancellation

Access to the data tools of the MCP server requires a subscription, billed in advance through Stripe: monthly (USD 9), every 6 months (USD 49) or yearly (USD 99). The 6-month and annual plans include Órbita Horizonte. Taxes may apply.

Your subscription renews automatically at the end of each period (monthly, every 6 months or yearly, depending on your plan) at the then-current price until you cancel. You can cancel at any time, online, from your account (Manage billing). Cancellation takes effect at the end of the current billing period, and you keep access until then.

We will notify you by email before any price change; the new price applies from the next renewal after the notice, and you can cancel before it takes effect. Refunds are described in the Refund and Cancellation Policy.

6. Acceptable use

You may use the Service for your own trading and research. You may not resell, redistribute, publish or share the plan, the orders, the research base or the desk's notes with third parties, share your account or tokens, circumvent access controls or rate limits, scrape the Service, or use it in violation of any law.

We may suspend or terminate access that breaches these terms or puts the Service or other users at risk.

7. Intellectual property

The Service, its content, research, plans, skills, software and brand belong to Órbita or its licensors. We grant you a personal, non-exclusive, non-transferable license to use them while your subscription is active and according to these terms.

8. Availability and changes

We aim to keep the Service available, but it is provided without guarantees of uptime, timeliness or accuracy. We may change, suspend or discontinue features, including the list of covered companies. If we discontinue the Service, we will refund the unused part of the current billing period.

9. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, Órbita disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Órbita is not liable for any trading losses, lost profits or indirect, incidental, special or consequential damages arising from the Service or from orders placed by you or your agent. Órbita's total liability for any claim is limited to the amounts you paid for the Service in the three months before the claim.

Nothing in these terms limits rights that cannot be limited under the consumer protection laws of your country.

11. Indemnity

You agree to indemnify Órbita against claims arising from your use of the Service, your trading or your breach of these terms, except to the extent caused by Órbita.

12. Governing law and changes to these terms

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, and without prejudice to the mandatory consumer protection laws of your country of residence.

We may update these terms. If a change is material, we will notify subscribers by email at least 15 days before it takes effect. Continuing to use the Service after that date means you accept the new terms.
